Terms and Conditions Agreement for Moroco Guide Tour Operator Agency
The following Terms and Conditions Agreement (the “Agreement”) is a legal agreement between Moroco Guide , a Souss massa / Morocco corporation (referred to as “we”, “us”, or “our”) and the individuals or entities (referred to as “you” or “your”) that book tours or travel services through us. By booking a tour or travel service through us, you agree to be bound by the terms and conditions set forth in this Agreement.
- Booking and Payment To book a tour or travel service with us, you must provide us with your name, contact information, preferred dates, and payment information. We accept payment by credit card or other forms of electronic payment. Payment is due in full at the time of booking, and we will not confirm your reservation until we receive full payment.
- Cancellation and Refunds If you need to cancel your tour or travel service, you must notify us in writing as soon as possible. The amount of the refund you will receive depends on the timing of your cancellation, and is subject to our cancellation policy. If you cancel more than 2 days before the tour or travel service, you will receive a full refund, minus any non-refundable fees or expenses we incurred. If you cancel within 2 days of the tour or travel service, you will not receive a refund.
- Changes to Your Itinerary We reserve the right to make changes to your itinerary due to circumstances beyond our control, such as weather, natural disasters, or other unforeseen events. We will make every effort to provide you with a comparable alternative tour or travel service, but we cannot guarantee availability or the exact itinerary.
- Insurance We strongly recommend that you purchase travel insurance to protect yourself against unforeseen circumstances such as illness, injury, or trip cancellation. We are not responsible for any losses, damages, or expenses incurred due to your failure to purchase travel insurance.
- Liability We are not liable for any damages, losses, or expenses incurred as a result of the actions or omissions of third-party providers, such as airlines, hotels, or transportation companies. We are not liable for any injuries, damages, or losses incurred during the tour or travel service, including but not limited to accidents, illnesses, or thefts.
- Health and Safety By booking a tour or travel service with us, you acknowledge and agree that travel involves certain inherent risks and hazards, and that you are responsible for your own health and safety. We are not liable for any injuries or illnesses incurred during the tour or travel service, including but not limited to those resulting from your failure to follow our instructions or the instructions of our guides.
- Intellectual Property We own all intellectual property rights in our website, marketing materials, and other content related to our tours and travel services. You may not use any of our intellectual property without our prior written consent.
- Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State/Country in which we are incorporated, without giving effect to any choice of law or conflict of law provisions.
- Entire Agreement This Agreement constitutes the entire agreement between you and us, and supersedes all prior agreements, representations, and understandings, whether written or oral.
- Amendments We reserve the right to amend this Agreement from time to time, and will post any amended terms on our website. Your continued use of our services after any such amendments will be deemed acceptance of the amended terms.
- Severability If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By booking a tour or travel service with us, you acknowledge that you have read, understood, and agreed to the terms and conditions set forth in this Agreement. If you have any questions or concerns about these terms and conditions, please contact us before booking.
- Dispute Resolution Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the State/Country in which we are incorporated, and the arbitrator’s decision shall be final and binding.
- Waiver Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision or of our right to enforce such provision in the future.
- Assignment You may not assign this Agreement or any of your rights or obligations hereunder without our prior written consent.
- Force Majeure We shall not be liable for any delay or failure to perform our obligations under this Agreement if such delay or failure is caused by events beyond our control, such as acts of God, war, terrorism, natural disasters, or other emergencies.
- Termination We may terminate this Agreement at any time, with or without cause, by providing you with written notice. Upon termination, we shall refund any amounts paid by you for services that have not yet been provided.
- Headings The headings in this Agreement are for convenience only and shall not affect its interpretation.
- Language This Agreement may be translated into other languages, but the English language version shall govern in the event of any conflict or discrepancy.
